UN Court agreed to introduce provisional measures against RF to protect minorities in Crimea

The International Court of Justice agreed to introduce the measures on the Ukraine vs Russia case in order to protect national minorities in Crimea, the ICJ President Ronny Abraham told during the open hearing in the Hague. 

The Court considers the violations within the provisions of the Convention on the Elimination of All Forms of Racial Discrimination.                                                                                                          

The Court noted that the violation of the Articles 2 and 5 referenced by Ukrainian party are aimed at the protection of natural persons from the displays of discrimination. In order to introduce provisional measures, the party may register a claim only when there are evidences of the displace of racial discrimination. 

“As regards the testimonies given to the court, some of them fall under the definition of discrimination, for example, in the part of getting education in the Ukrainian language for ethnic Ukrainians. At the moment, the court concluded that Crimean Tatars and ethnic Ukrainians in Crimea remain vulnerable. In this context the court takes into account the report on the situation with human rights in Ukraine,” Mr. Abraham said. 

In addition, the Court stated tha the Russian Federation shall: 

- refrain  from  maintaining  or  imposing  limitations  on  the  ability  of  the  Crimean  Tatar

community to conserve its representative institutions, including the Mejlis; 

- ensure the availability of education in the Ukrainian language. 

The court also obliged both parties to avoid the violation of the Convention on the Elimination of All Forms of Racial Discrimination. 

Abraham added that the Court notes that the requirement and the parameters for applying temporary measures based on the Convention on the Elimination of All Forms of Racial Discrimination are valid and thus, the Court makes the decision for these measures to be completely or partially indicated based on the articles stated by Ukrainian party.
